It's not over. There is too much money involved. Appeals or new laws are likely the future; it won't die easily.
Or it will come back attached to some anti-terror law.. either way, you are correct. Too much cash and control involved.. look for this one to come back with a vengence.

Here is a guess on one form it could take if new laws and courts don't help them with their agenda:
* Some sort of encryption or "new" coding standard will be created.
* "Decoder" boxes or firmware upgrades will be made available at the cost of "signing" an EULA where the consumer agrees to accept limits of a broadcast flag at home.
* The big players will charge less for those who agree to the new system and continue to raise prices for those who don't because "supporting a legacy product that is end of life is more expensive than the new product."
* People will complain
* Suddenly, hackers are popular again, and the dc-forum top question is, "How can I hack 'teh' broadcast flag on my DVR/PVR/DVD-R/etc. ?"
I posted (the story) to slashdot and got beat out by thirty minutes. I think my headline was: "No July 1 deadline to buy a uncorrupted videocard" or something.

They are looking at writting law to get the flag back, after court ruled FCC didn't have these powers. So now they are putting the law in to give FCC these powers.
