  • On the heels of RIAA win...

    Just heard on the radio that Radiohead will be releasing their new album In Rainbows online, without record label, for free or whatever you decide to pay for it.

    It is important to note about the RIAA decision that the trial judge told the jury that "making available" was sufficient to determine copyright infringement. In other words, the RIAA did not have to prove actual file transfer, only that it was available to transfer.

    This is very controversial and will certainly be a major issue on appeal (if they appeal).

      So when you visit my house and I say "Make yourself at home" then I just made available 900 CDs and committed violations?

                  This reminds me of the baseball strike. People started watching little league games and other normal people who played, just to spite the big guys.
