And the year listed is the year the copyright begins. So you're saying that it doesn't go into effect until 2012, which means anyone is free to steal your shit until then.
Actually to secure a copyright all you need to do it put the (c), the date, and your name. I do lots of photograpy and I hold the copyrights to those images.
To "properly" secure the copyright you need to file the item with the Library of Congress.
Whether you have files or not makes no difference on the enforcement of your copyright. Where the difference arises is in lawsuits for copyright infringement. When you have filed with the Library of Congress you get to sue for damages. If you only put the (c), date and name, you can sue for the user to cease and desist.
I had one of my photos used without payment to me. Had I filed I am told I could win $50,000. But considering the number of phtoos that I shoot, I would spend more than that in filing fees alone over the decades.
